The Continuous Variable Transmission (CVT) system began malfunctioning immediately after service for Recall R25A8 in March. Initial symptoms included severe hesitation, shuddering, and erratic shifting, as well as an occasional CVT light that would turn on and off. I expressed these concerns to the dealership, but the issue was not acted on because they initially could not reproduce or confirm the symptoms during prior visits. Recently, the dealership replicated the issue and confirmed a complete transmission failure requiring a full replacement. The vehicle and failed component are available for inspection upon request. The vehicle is only 4 years old, and research shows this CVT failure is a widespread issue among Nissan vehicles. The sudden loss of acceleration and erratic shifting created a safety hazard during highway merging and navigating busy intersections, placing occupants and surrounding traffic at risk of a rear-end collision.

    ENGINE

Summary of Safety Defect & Incident: On August 27, 2026, while driving, the vehicle experienced a sudden and total loss of motive power / engine stall without any prior warning lights, check engine lights, or temperature indicators on the dashboard. This sudden engine stall created an immediate safety hazard in traffic. The vehicle could not be safely restarted and was towed directly to an authorized Nissan dealership. Upon dealership evaluation, the service department diagnosed a failed Exhaust Gas Recirculation (EGR) system and a blown head gasket, requiring a total engine replacement. Context & Recall History: This vehicle was previously serviced by an authorized Nissan dealer in early 2026 for Safety Recall 25V437 / NHTSA campaign concerning 1.5L VC-Turbo engine bearing and thermal failure risks. The recall software remedy was applied at that time. Despite complying with the recall service, the engine suffered catastrophic thermal/mechanical failure at 68,000 miles. The occurrence of a complete engine stall without dashboard warning, following a completed recall service, indicates that the software remedy did not prevent severe internal engine failure. The vehicle is currently held at the dealership awaiting resolution from Nissan Consumer Affairs. No crash or injuries occurred, but the risk of collision during sudden loss of power at speed remains severe.

Incident Summary & Safety Hazard: Nissan North America and its dealership failed to perform a timely safety recall repair (NHTSA 25V-437 / 26V-080), resulting in complete engine failure and sudden loss of power in active traffic. Essential replacement parts are on national backorder, leaving the vehicle inoperable. Timeline: June–Late 2025 (~105k miles): Attempted to get the recall repair at Tom Peacock Nissan 3–4 times. Turned away each time due to lack of parts/remedy. Jan 2026 (~121k miles): Engine lost power and made severe internal noise while driving. Dealer reflashed ECM and used a borescope, claiming a metal piece on a piston was "unrelated to the recall." They refused to inspect the bearings per protocol and demanded $8,000 for repair without a diagnostic breakdown. Sept 2026: Total engine failure while driving; vehicle stalled completely. An independent shop confirmed failure due to progressive bearing wear linked to the recalled defect. Nissan refused coverage because mileage passed 120,000 miles, despite repeated pre-failure recall attempts starting at 105,000 miles. Current Status: Purchased a replacement engine out-of-pocket (Nissan Order #180929 and #181725). Parts are on national backorder with no estimated delivery date. Requested Action: I request NHTSA investigate Nissan's failure to supply timely recall remedies, turning away owners prior to failure, and denying coverage for damages caused by known defective engine bearings.

Nissan rouge was inspected for recall 26V080, engine bearing Failures.  A few months later the engine bearings failed.  My wife was driving the vehicle alone, 5 days after having a pacemaker implanted when the bearings/engine failed. The vehicle would move slowly with fits and starts and randomly shutdown and then have to be restarted.   This was clearly a danger to my wife and other vehicles on the road with her. Luckily a sheriff came along, saw the danger of the situation and escorted my wife home. CLEARLY,  Nissans actions to inspect and reprogram the ECM do not work in preventing this failure.  Nissan must be forced to go back to dropping the oil pan and inspecting it for debris. This cost me 200 in towing fees and stranded us in [XXX] for 2 weeks with a cost that I have yet to calculate. Had the oil pan been inspected we could have avoided the dangerous situation my wife found herself in and it would have been repaired in [XXX] where we live. My 2022 Nissan Rogue 1.5L VC-Turbo is experiencing repeated limp-mode/reduced-power events, severe hesitation, poor acceleration, rough/shaking idle, and recurring DTC U0652 after Nissan marked recall 25V-437 complete. The vehicle is available for inspection. Reduced-power symptoms were documented as early as Dec. 2024 and significantly worsened by Oct. 3, 2025 at approximately 100,400 miles, including loss of power at highway speed. I previously reported this condition to NHTSA under Complaint #11696068. The first Nissan dealer (Willis) used a borescope, claimed “sludge,” recommended engine replacement, refused to provide supporting photos/evidence, and did not remove the oil pan. Willis later provided me an oil sample, which I submitted for independent analysis. That analysis showed multiple bearing-associated wear metals without an abnormal viscosity condition explaining the findings, and confirmed the oil pan was had not been checked. A second Nissan dealer was contacted to performed Nissan’s recall screening/software procedure. No engine light could be on upon arrival. Because the intermittent condition did not occur during the brief test, Nissan marked the recall complete. The warning light is now illuminated again and the vehicle is again entering limp mode/reduced power. I contacted Nissan for assistance and was told they would not provide towing or further recall assistance because the recall is listed as complete. I am currently stranded with the same safety condition after Nissan declared the vehicle remedied. My complaint is failed recall remedy/recall effectiveness. Nissan’s screening process classified this vehicle as remedied, but the safety condition continues and appears progressive. Nissan is now using its own “recall complete” status to refuse further action despite recurring loss of power and independent evidence of internal engine wear.

On June 12, 2026, while driving my 2022 Nissan Rogue on the Grand Central Expressway in New York, the engine suddenly shut down and the vehicle lost motive power in active highway traffic. The vehicle would not restart. I called 911, and police responded and protected the disabled vehicle until it could be towed to safety. I later learned the vehicle was subject to Nissan Safety Recall R25D1 / NHTSA 25V-437 involving engine bearing defects that may cause engine damage and loss of motive power. A Nissan dealer inspected the vehicle and documented that the engine would not turn over. The technician removed the oil pan, found metal debris, and determined the engine was seized. Nissan subsequently replaced the engine and turbocharger. After the replacement, I began experiencing additional problems. The vehicle hesitated during acceleration. On August 15, the Check Engine light illuminated with an “Engine Malfunction” warning. The dealer subsequently replaced an exhaust-related sensor. On August 23, the SRS/Air Bag warning light illuminated and remained on before later turning off. The same SRS warning occurred again on August 24, and the vehicle also failed to start on the first attempt. On August 26, another warning appeared stating “Malfunction – See Owner’s Manual.” Nissan Consumer Affairs advised me that these subsequent problems are unrelated to the engine recall. I am concerned about the continuing safety and reliability problems occurring shortly after the engine and turbo replacement and am requesting that NHTSA document and evaluate these incidents for a potential safety defect.

My 2022 Nissan Rogue has entered reduced-power/limp mode approximately nine times. The specific component causing the malfunction has not been identified. The vehicle is available for inspection upon request. When the malfunction occurs, the vehicle displays a malfunction/reduced-power warning and substantially reduces available engine power. Several occurrences happened during a long-distance trip involving highway, mountain, and desert driving. The unexpected reduction in power creates a safety concern during highway travel, merging, passing, climbing grades, or travel in remote areas. The problem is intermittent and has not been successfully reproduced by an authorized Nissan dealership. I presented the vehicle to a Nissan dealer and reported the repeated events while the vehicle had approximately 56,500 miles and remained below Nissan's 60,000-mile powertrain warranty mileage limit. The dealership advised that it could not diagnose the problem unless the malfunction occurs again with an active diagnostic code. I have also reported the problem to Nissan Consumer Affairs. The underlying cause remains unidentified and the vehicle has not been repaired for this condition. Warning messages appear when the malfunction occurs. During the long-distance trip, diagnostic codes were cleared to restore vehicle operation. The vehicle would then operate normally for a period before unexpectedly entering reduced-power mode again. My primary concern is that after approximately nine occurrences, I still have no diagnosis or assurance that the condition will not recur during highway operation or another situation where maintaining vehicle power is necessary for safe operation.

Engine failure, known issue per Nissan service employees, second and third combustion cylinders fill with anti-freeze coolant with no errors or warning lights in vehicle. This was noticed by the temperature gauge climbing during acceleration and falling while at speed. I am told it is a manufacturing defect by the service department but due to the 76,000 miles on the 2022 vehicle it is not covered by Nissan, an $8000 bill for the long block replacement. I drove it straight to the nearest Nissan dealership. In that time driving to the dealership my car barely would go over 60 mph and the RPM's would go high then low. The dealership looked it over later in the day and called me and said that 'nothing is wrong with it.' No error codes. No problems. They drove it 30 miles. I am not satisfied with this. THIS IS A MAJOR SAFETY issue and I am scared to drive again knowing I may not be able to accelerate on the interstate. I took a picture of my dashboard and errors that showed when I was pulled over and I gave this to the dealership. They still said nothing was wrong. Re: Formal Demand for Repurchase or Replacement Under Utah Law and the Magnuson-Moss Warranty Act Vehicle: 2023 Nissan Rogue VIN: [XXX] Current Mileage: 104732 To Whom It May Concern: I am the owner of a 2023 Nissan Rogue and am writing to formally demand that Nissan North America, Inc. resolve a serious and ongoing defect affecting my vehicle by repurchasing the vehicle, replacing it with a comparable new vehicle, or otherwise providing an appropriate remedy. The vehicle has experienced a substantial defect involving the continuously variable transmission (CVT). Nissan replaced the original CVT under the manufacturer's warranty at no cost to me. However, immediately following that replacement, the replacement transmission began exhibiting serious defects, including seizing, repeated stalling while driving, and the appearance of electrical fault codes. The vehicle continues to stall unexpectedly, creating an unreasonable safety risk for me, my passengers, and other motorists. A vehicle that loses propulsion while in traffic cannot reasonably be considered safe, reliable, or fit for its intended purpose. Despite Nissan's opportunity to repair this defect, the problems remain unresolved. Replacing one defective transmission with another defective transmission has not corrected the underlying issue. These defects substantially impair the vehicle's use, value, and safety. I have complied with Nissan's warranty requirements by presenting the vehicle to authorized Nissan dealerships for diagnosis and repair. Nissan has been afforded a reasonable opportunity to repair the vehicle but has been unable to provide a permanent remedy. Accordingly, I believe I may be entitled to relief under applicable Utah law governing warranty obligations and defective new motor vehicles, as well as under the Magnuson-Moss Warranty Act, 15 U.S.C. §§ 2301–2312, which provides consumers with remedies when a manufacturer fails to honor its written warranty obligations. I am reporting a serious safety concern involving my 2022 Nissan Rogue equipped with the 1.5L engine. While driving in normal traffic, my vehicle suddenly displayed an "Engine Malfunction" warning with no prior indication of an engine problem. Immediately after the warning appeared, the vehicle rapidly lost power and could no longer maintain the speed of surrounding traffic. I had very limited ability to accelerate or safely maneuver, creating a significant risk of being struck from behind or becoming stranded in an active travel lane. There was no advance warning that a catastrophic engine failure was imminent. The vehicle ultimately became inoperable and was towed to an authorized Nissan dealership. The dealership diagnosed the engine with coolant leaking into the cylinders and determined that replacement of the engine assembly, turbocharger, and catalytic converter was required at an estimated cost exceeding $10,000. My vehicle had previously experienced engine-related concerns and was included in Recall Campaign R25D1. That recall was completed, but less than 30 days later the engine failed catastrophically. Based on this sequence of events, I am concerned that the existing recall may not identify or address all engine conditions that can result in sudden loss of motive power and catastrophic engine failure. I have since learned of numerous publicly reported complaints from other owners describing similar failures involving coolant intrusion, sudden loss of power, and complete engine replacement in 2022 Nissan Rogue vehicles equipped with this engine. I respectfully request that NHTSA investigate whether these engine failures represent a broader safety defect and whether additional corrective action is necessary to protect the driving public.

Problem: CVT transmission failure with code P187E at 73500 miles. Nissan dealer confirmed clean fluid but quoted $9800 for transmission replacement. Vehicle still drives but repeatedly enters failsafe/limp mode, limiting speed and acceleration without warning. This occurred multiple times on the highway, creating a serious safety hazard due to sudden loss of power in trafic. This is a know issue with hundreds of similar complaints filed for 2022 Rogue 1.5 CVT models. The failure pattern is consistent: code P187E, failsafe mode activation, and dealer recommending full CVT replacement even with proper maintenance. Safety concern: Sudden loss of power while driving on highway. Vehicle speed drops unexpectedly from 65+ mph to under 40 mph when failsafe mode engages. This creates high risk of rear-end collision, especially durng merging or in heavy traffic. My family and other drivers are at risk.

I have a 2022 Nissan Rogue SV that had an engine replaced due to a faulty head gasket in March of 2024 and my vehicle on 6/15/2026 had a rough idle of the engine and irregular RPM's which then led to the RPM's dropping to zero while in a stationary drivethru lane. The vehicle then showed a caution warning indicating to shift the car into Neutral. After getting the car towed to the dealership for diagnostics it was determined that the vehicle requires a new engine. The likely cause according to the service advisor was a failed head gasket, which was the same reason for the first engine replacement. Despite the fact the engine will be covered under warranty, the possibility of the engine failure occurring on the highway while traveling at a high rate of speed, and potentially stranding me on the highway with no warning is a high cause for concern given the vehicle would have went into limp mode, which limits the vehicle to less than 15 MPH.

June 8th, 2026 I was driving to work when my car began to have problems accelerating. My cars acceleration was inconsistent and would not allow for appropriate throttle response. After realizing this was not a fuel delivery problem I tried to come to a safe area to pull over in which I could not do so rounding a roundabout. After making it through the roundabout my cars acceleration was depleting fast. I pulled over as much as I could before I put the car in park and turned the engine off. After the engine was turned off I attempted to restart it. Upon restarting the vehicle began to shake violently as if the back tires were still in rotation and began making an awful noise. I turned the car off and called someone to come assist me. Moments later a random civilian operating under the name “bulldogs handyman and roadside assistance” pulled up behind me. He attempted to help me restart the car to understand what was going on. The car at this point could not turnover. He then asked me “are you out of gas” because visually my car was perfectly fine. I was indeed at half a tank. The man then plugged a code reader into my car and received the code A11P7. At this time a light finally went off on my dash board showing “check engine” symbol. We called Nissan due to the recent recall on my car and had it towed there. The Nissan dealership claims my EGR cooler failed resulting in coolant to enter my engine and overheat the engine causing it to fail. However, Nissan refuses to check the oil pan because the code specifically installed for the recall did not populate. Their diagnoses is plausible however, I just had a multi point inspection 4 months ago by this exact dealership. My cars mileage is 71,315 miles. All maintenance is up to date and I never had a coolant leak. I have had many people INCLUDING EMPLOYEES tell me about the EGR cooler failing and how it is a known problem for Nissan. The EGR cooler needs to be inspected in these models! They are defective.

I own a 2022 Nissan Rogue with approx 71,139 miles on. While driving on the freeway at 65mph, the vehicle suddenly lost power and became disabled. Prior to the failure, the vehicle did not dispaly an overheating warning, coolant warning, or other indication the engine was overheating or experiencing coolant loss. The vehicle was being driven normally and was on the way to routine maintenance and fuel stop when the failure occurred. An independent repair facility diagnosed coolant intrusion into the combustion chamber and determined the engine had overheated and required replacement. The vehicle's sudden loss of propulsion occurred without warning creating a safety hazard for myself and my daughter as I was forced to coast to a stop in the Gore Area of the freeway just as you entered the [XXX] from [XXX] due to the inability to maintain speed on the freeway. This was the safest area for us to park but it was terrifying as cars zoomed past us from both sides. I am concerned that the engine failed without adequate warning to the driver and that similar complaints have been noted by several others describing the same issue with the same year, make and model as my car. Multiple reports have said it occurred while on the freeway, making this a greater concern for safety. I took my car to Nissan who stated they see the coolant intrusion, but that it was not covered under recall. I asked what caused the internal leak, to which they replied that would require them to take apart the engine to examine further at my cost. I advised the issue with the car not indicating it was even out of coolant to cause it to overheat was concerning because even if I replace the engine, if the electrical failure isn't addressed I could run into the same issue and this time actually get into an accident that could cause death or serious injury. I own a 2022 Nissan Rogue that has experienced multiple critical safety defects. The vehicle has repeatedly lost engine power without warning, exhibited delayed acceleration, and failed to engage gears—creating dangerous driving conditions that have put me at risk. Service History and Warranty Disputes: February 20, 2026: I brought the vehicle to the dealership after experiencing loss of engine power. Diagnostics revealed that the EGR Pressure Sensor had internally shorted, causing a loss of communication diagnostic trouble code. The service department replaced the exhaust gas pressure sensor assembly. Despite the defect being a manufacturing fault and my purchase of a wraparound warranty, I was charged out of pocket for this repair. When I questioned the warranty coverage, I was transferred to consumer affairs and informed that only the dealership determines what is covered—an unsatisfactory response to a valid warranty claim. May 20, 2026: I returned to the dealership after the vehicle lost engine power again and lurched violently forward with jerking motions. The service department replaced the engine mounts. However, after only one day of driving, the same dangerous symptoms returned. May 29, 2026: I brought the vehicle back to the dealership for recurring loss of engine power, delayed acceleration, and violent lurching. The service department replaced the EGR system, which subsequently caused the spark plugs to warp. I was charged $400 for this additional repair, despite these being recurring manufacturing defects that should be covered under warranty. Conclusion: This vehicle demonstrates a pattern of dangerous, unresolved mechanical failures. The repeated issues—combined with warranty coverage disputes and repeated out-of-pocket charges for factory defects—indicate serious safety and reliability concerns with this 2022 Rogue.

The contact owns a 2022 Nissan Rogue. The contact received notification of NHTSA Campaign Number: 25V437000(Engine and Engine Cooling). The vehicle was taken to the dealer where the contact was informed that the dealer reprogrammed the engine control module (ECM) software and test drove the vehicle and found no failures. Despite the dealer's claims that they test drove the vehicle, the contact stated that her mileage had not changed upon picking up the vehicle. The contact then stated that while driving at 55 MPH, an audible ding sound emitted from the vehicle as both an "Engine Malfunction" and "Power Reduced Service Now" warning messages appeared on the instrument panel. The vehicle began to slow down upon depression of the accelerator pedal. While at a stop light, the vehicle failed to accelerate above 5 MPH as the contact coasted the vehicle into a parking lot. Due to the failure, the vehicle was towed to another dealer where after the dealer spoke with the manufacturer; they agreed to repair the vehicle under the initial recall. The contact had yet to notify the manufacturer directly about the failure. The vehicle had yet to be repaired and remained in the possession of the dealer. Dealership says this is a normal sound on Nissan Rogues with the 1.5 cyl turbo charged engine. When I use 89 octane fuel the knocking sound seems less pronounced but, The manual on my 2022 Nissan Rogue says to use 87 octane. Is there anything we can do if the dealership refuses to acknowledge there is a problem which needs to be addressed?

Subject: Safety Complaint and Recall Concern – 2022 Nissan Rogue Engine Failure and Resulting Consumer Harm (VIN: [XXX] ) To Whom It May Concern, I am submitting this complaint to report a catastrophic engine failure involving my 2022 Nissan Rogue (VIN: [XXX] ), and to request review of potential safety and recall-related concerns. In November 2025, while I still owned and was actively financing this vehicle, it experienced a sudden and complete engine failure attributed to an engine control module (ECM) / engine-related issue. This failure rendered the vehicle inoperable without warning. At the time of failure, I was not informed by the dealership of any existing or potential recall, defect investigation, or manufacturer responsibility that may have applied to this condition. I was advised that the vehicle was no longer viable and was directed into purchasing a replacement vehicle. As a result, approximately $17,958.15 of remaining debt from the failed Rogue was rolled into the financing of a replacement vehicle, creating significant and ongoing financial harm. I have since become aware of recalls and defect investigations affecting Nissan Rogue vehicles in this model range, including conditions involving engine failure risks that may require inspection, repair, or replacement at no cost to the consumer. My concerns are as follows: 1. Whether the engine failure I experienced is related to known defects or recall conditions involving the Nissan Rogue. 2. Whether adequate notice, disclosure, or remedy information was available or communicated to consumers and dealerships at the time of my vehicle failure. 3. Whether this failure represents a broader safety issue that may affect other drivers. 4. Whether consumers may be incurring avoidable financial harm due to lack of awareness of recall-related remedies. This failure created both a potential safety risk and significant financial consequences that I believe may have been preventable if INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6)

My 2022 Nissan Rogue has experienced repeated engine failures beginning at approximately 88,000 miles, including four separate incidents despite repairs performed at authorized dealerships. The vehicle exhibited engine knocking and drivability issues prior to failure. Nissan later issued a recall related to engine issues, and recall service was performed on January 29, 2026. The engine failed catastrophically less than 30 days later and was diagnosed with coolant intrusion into the cylinders requiring full engine replacement. The recall inspection appears to have been limited to a computer scan and did not identify the underlying issue. This raises concerns that the defect may not be properly detectable through the current recall procedure. I am reporting this as a potential safety concern due to repeated engine failure and loss of confidence in vehicle reliability.

When I glanced, I did not see anything at the time. When this happened, there were no other cars in front of me. Later at home, I checked again, did not see anything. Two days later, I got into the car and there was a crack from the lower frame moving up the glass about 7 inches. As the days went by the crack got longer. I did not see a point of impact. As far as I could tell, the crack started from the frame. Unfortunately, I did not take any photos. I contacted Patrick at windward nissan dealership parts department directly (his personal cell phone); he told me to utilize Ace auto glass. There was no inspection by dealership or insurance. Utilized Safelite for replacement. There was no warning of any failure by cars system.

I am reporting a safety defect involving my 2022 Nissan Rogue related to NHTSA Recall 25V437 (engine bearing failure). Prior to complete engine failure, I experienced multiple instances of sudden loss of power while driving at highway speeds, creating a serious safety hazard. In one instance, this nearly resulted in a multi-vehicle accident in heavy traffic. The vehicle also exhibited additional symptoms consistent with the recall, including engine shaking, knocking noises, rough riding and hard shifting, burning smell, and warning lights. Nissan performed the recall service, which consisted of reprogramming the Engine Control Module (ECM). However, this software update did not repair or replace the defective engine components. The vehicle’s condition worsened after the recall service. The engine ultimately failed completely at approximately 122,000 miles, shortly after the recall repair was completed. This indicates that the recall remedy is ineffective and does not adequately address the safety risk, as a software update cannot prevent or correct pre-existing mechanical failure of engine bearings. I am concerned that other vehicles with this defect remain at risk of sudden power loss and potential crashes despite having the recall performed.

The issue first began in February 2026, when the vehicle started showing signs of engine malfunction and poor performance, which ultimately led to a full engine replacement by an authorized Nissan dealership. After the engine replacement, the vehicle continued to experience serious and recurring drivability issues. On multiple occasions, including March 16–17, 2026, and most recently on April 11, 2026, the vehicle failed to accelerate properly even when the gas pedal was fully pressed. The vehicle would move extremely slowly and felt as if it was stuck in a low gear, with loud engine noise and lack of power. This created a significant safety hazard, as I was unable to accelerate normally in traffic, increasing the risk of being rear-ended or unable to safely merge or cross intersections. Additional symptoms included: •Engine shaking while idling •Intermittent loss of power and poor throttle response •Transmission not shifting properly •A/C blowing warm air at idle but cold while driving •A diagnostic issue indicating loss of communication with a control module (VCR/module) The problem is intermittent and unpredictable, making it difficult to demonstrate on demand, but it has occurred multiple times in real driving conditions. The vehicle has been inspected multiple times by an authorized Nissan dealership, including technicians and a shop foreman. The dealership has stated they were sometimes unable to reproduce the issue and have attempted repairs such as performing an idle relearn, but the problem persists. Despite major repairs, including a full engine replacement, the vehicle continues to experience dangerous loss of acceleration and drivability issues, posing an ongoing safety risk. The vehicle is available for inspection upon request.

My 2022 Nissan Rogue experienced a sudden engine failure related to an active recall. The vehicle became undrivable and was taken to the dealership. The vehicle has now been out of service for over two weeks with no estimated repair completion date. This failure creates a serious safety risk, as engine failure can occur while driving and could lead to loss of power, stalling, or inability to safely operate the vehicle. The dealership has confirmed the issue but has not provided a timeline for repair. Nissan has only offered rental reimbursement, requiring out-of-pocket payment, and has not provided a loaner or direct rental despite the recall-related failure. I am currently without reliable transportation due to this failure and cannot afford to pay upfront for a rental. This has created a financial hardship. This issue should be investigated, as it involves engine failure tied to a recall and lack of adequate support while the vehicle is out of service.

Hi! This is my 2nd input here about my 2022 Nissan Rogue. Recaping that whike driving home, smoke began to emerge from under the hood and multiple warning signs popped up (please see previous input for more information). Cureentky, my vehicle was diagnosed with a converter issue. The recent recall was related to the engine. The converter and my spark plugs (2 spark plugs replaced already) were all damaged by the engine. This makes sense why there are numerous issues. While the extended warranty covers the engine and not the converter, under the law of consequential damage, anything damaged by this engine is covered due to the cause from the engine. I currently have a rental and am leaving my Rogue at the dealership due to it being unsafe to drive and that the dealership has not provided a remedy for this defect, which is covered by law under this recall on the Rogue due to consequential damage. My Rogue will continue to have issues until all related/noncoverd parts are fixed under this. This vehicle is now a lemon due to consistent issue with the engine it damaging other parts. I am hoping for a good will pay and buyback.

Subject: URGENT SAFETY COMPLAINT - 2022 Nissan Rogue (VIN: XXX) - Recall Remedy Failure I am filing a formal complaint regarding a life-threatening defect in my 2022 Nissan Rogue. This vehicle has experienced three (3) total losses of motive power at highway speeds, nearly causing multiple accidents. I am now afraid to drive this vehicle as it remains a substantial safety hazard. Recall & Repair Failure: The vehicle is subject to Recalls R25E2 and R25E3 for engine bearing and throttle body failure. The dealership performed an ECM software update which effectively removed the "open recall" status from my VIN history. However, the dealer refused to perform the mandatory physical oil pan inspection for metal debris required by the recall protocol. The car still exhibits severe bucking, hesitation, and gurgling noises. By only performing a software "fix," the manufacturer has cleared the safety alert while leaving a catastrophic mechanical defect unaddressed. This is a complete remedy failure. 30-Day Out-of-Service & Misdiagnosis: In January 2025, the dealership retained my vehicle for over 30 days. During this stay, the service department initially informed me via text that the engine required a full replacement. The following day, they abruptly changed the diagnosis to spark plugs. I have text records of this contradiction. This 30-day stay meets the statutory presumption of a "Lemon" under Florida Statute 681.104. Unresolved Issues: Despite replacing the throttle body, EGR valve, water pump, and various mounts, the engine still stumbles, especially from a stop. The dealer manager previously discussed a vehicle swap but attempted to force a new credit application, treating a safety-defect remedy as a new sale. I am seeking a Substitution of Collateral (Swap) on my existing loan terms for a reliable vehicle.
